Terms of Service
The agreement between you and AissaGames for using Kharbga and this website.
1. Acceptance of terms
These Terms of Service ("Terms") form a binding agreement between you and AissaGames ("we", "us", "our") governing your access to and use of the game Kharbga and this website (together, the "Services"). By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.
3. Accounts
Some features require an account provided through Unity Player Accounts. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
4. Guest accounts
You may play Kharbga using a guest account without signing in. Guest progress is tied to your device and may be lost if the app is uninstalled, the device is reset, or local data is cleared. To protect your progress across devices, we recommend linking your guest account to a Unity Player Account (via Google or email). We are not responsible for guest progress that is lost because it was never linked.
5. Unity Player Accounts
Account, sign-in, save, and leaderboard functionality is provided through Unity Gaming Services. Your use of Unity Player Accounts is also subject to Unity's applicable terms and privacy policy. You are responsible for the sign-in provider you choose (such as Google or email) and for keeping it secure.
6. Fair play
Kharbga is a game of skill meant to be enjoyed fairly. You agree to play honestly and to respect other players. You must not harass, abuse, or disrupt other players, manipulate matchmaking or leaderboards, or otherwise interfere with the intended operation of the game.
7. Anti-cheat
You must not cheat, exploit bugs for unfair advantage, use unauthorised third-party software, bots, or modifications, tamper with game files, or attempt to falsify scores or currency. We may validate gameplay using server-side logic (Unity Cloud Code) and may reset scores, remove leaderboard entries, adjust balances, or suspend or terminate accounts that we reasonably believe have cheated.
8. Virtual currency & items
Kharbga may include virtual currency and virtual items used only within the game. Virtual currency and items:
- have no monetary value and cannot be exchanged for real money or transferred outside the game;
- are licensed to you for personal, non-commercial use within the game, not sold;
- may be earned through play and, in the future, purchased where such features are offered; and
- may be modified, managed, or discontinued as part of ordinary game balancing and operation.
You have no ownership right in virtual currency or items, and any unused balance is forfeited if your account is terminated for a violation of these Terms or when the Services are discontinued, except where prohibited by law.
9. Purchases & advertising
Kharbga is free to download and play. It offers optional in-app purchases — premium currency and cosmetic items — processed by Google Play Billing under Google's terms. Prices, availability and applicable taxes are shown at the point of purchase and may change. Purchased items are licensed to your account for use inside the game; they are not property, have no real-world value, and cannot be sold, transferred or exchanged for money.
The game also shows advertising supplied by Google AdMob, including optional rewarded ads that grant an in-game reward when you choose to watch one. Rewards are granted only after our server has verified the view with Google. Attempting to obtain rewards by falsifying that verification, or by any automated means, is a breach of the fair-play terms above and may result in the loss of the rewards concerned.
Subscriptions, a season pass, live events and tournaments are not part of this release and may be introduced in a future update, at which point these Terms will be updated to describe them.
10. Refund policy
Because purchases (when available) are processed by the platform store, refunds are handled according to that store's refund policy. For Google Play, please use Google Play's refund process; for the App Store, use Apple's. Where you have mandatory statutory rights to a refund, those rights are not affected by this section. If you believe you were charged in error, contact us and we will try to help resolve the issue.
11. License to use the game
Subject to these Terms, AissaGames grants you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Kharbga on devices you own or control, for your personal, non-commercial entertainment. This license does not transfer any ownership of the game or its content to you.
12. Intellectual property
The Services, including the Kharbga software, the "AissaGames" and "Kharbga" names and logos, artwork, audio, text, and design, are owned by AissaGames or its licensors and are protected by intellectual property laws. The traditional game of Kharbga is part of shared cultural heritage; our rights cover our specific implementation, branding, and creative assets, not the folk game itself. You may not copy, distribute, modify, or create derivative works from our content except as expressly permitted.
13. User generated content
If the Services allow you to submit content (such as a display name or feedback), you are responsible for that content and must ensure it is lawful and does not infringe others' rights or contain offensive material. You grant AissaGames a non-exclusive, worldwide, royalty-free license to use submitted content solely to operate and improve the Services. We may remove content that violates these Terms.
14. Restrictions
You agree not to: reverse engineer, decompile, or disassemble the game except where permitted by law; use the Services for any unlawful purpose; attempt to gain unauthorised access to our systems or other players' accounts; resell or commercially exploit the Services without our permission; or remove or alter any proprietary notices.
15. Termination
You may stop using the Services at any time and delete your account as described on our Delete Account page. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
16. Updates & availability
We may update, modify, or discontinue features of the Services at any time to maintain quality, security, and compatibility. We do not guarantee that the Services will always be available, uninterrupted, or error-free, and online features depend on third-party services such as Unity Gaming Services and your network connection.
17. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This section does not exclude warranties that cannot be excluded under applicable law.
18. Limitation of liability
To the maximum extent permitted by law, AissaGames will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, or virtual items, arising out of or related to your use of the Services. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Where liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us, if any, in the twelve months before the claim.
19. Governing law
These Terms are governed by the laws applicable at AissaGames' principal place of operation, without regard to conflict-of-law principles, and subject to any mandatory consumer protection rights available to you in your country of residence. Disputes will be handled by the competent courts of that jurisdiction, unless mandatory law provides otherwise.
20. Changes to these terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date and version number above and, where appropriate, notify you within the game or on this website. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
